Cruz: It
has come to our attention that on September 19, 2005 you publicly stated
you have never fully read the Constitution of the Commonwealth of
Pennsylvania. On September 20, 2005 the following quote regarding Article
II, Section 8 of that document was published and attributed to you by the
Philadelphia Inquirer: "I've
never read it," he said. "I'd be lying to you if I said I'd read
it." According to Article VI, Section 3 of the PA Constitution, a Representative in the General Assembly, before taking office, must take and subscribe the following oath: "I do solemnly swear (or affirm) that I will
support, obey and defend the Constitution of the United States and the
Constitution of this Commonwealth and that I will discharge the duties of
my office with fidelity." Additionally,
any Representative failing to take this oath "shall forfeit his office."
We are assuming you did take this oath upon your election in 2000, 2002
and 2004. Further,
for your reference, allow me to present you with the passage alluded to
from Article II, Section 8: "No member of either House shall during the
term for which he may have been elected, receive any increase of salary,
or mileage, under any law passed during such term." On
July 7, 2005 you voted in the affirmative on HB 1521, now known as Act 44,
which contains a provision whereby you and your colleagues in the General
Assembly can collect an additional "unvouchered expense allocation," a
direct violation of the passage from Article II, Section 8 cited above.
You have also personally applied for and collected these unconstitutional
sums. In
light of these revelations, it is apparent that not only have you failed
to adhere to the PA Constitution, but you also claim ignorance in your
defense of that failure, a claim which contradicts the oath you have
taken. Swearing
to support, obey and defend a document you have failed to read in its
entirety also represents a lack of professional integrity and honor.
Exercising legislative powers without full awareness and understanding of
the Constitution constitutes a clear violation of your oath of office.
You
have been in office for nearly five years and now admit ignorance of a
very basic constitutional provision. By doing so, you have made it
unmistakably clear that you swore a disingenuous and fraudulent oath of
office on three separate occasions. As
this oath is the only oath any Representative is required to make before
assuming office, we cannot imagine a more disrespectful way to treat the
people of the 180th district than by forcing them to be represented by
someone who does not understand the supreme law of our
land. When
- if ever - did you plan to read the Constitution of the Commonwealth of
Pennsylvania to determine if your actions were supporting, obeying, and
defending its mandates? You have characterized your position as "a 24-hour
job." Have you been too busy over the past five years to review a document
you should have read and understood prior to running for
office? Upon
reviewing your recent actions and statements, the fourteen-member Board of
Directors of PACleanSweep have voted unanimously to demand your immediate
resignation as representative of the 180th legislative district.
Failure to meet this demand will only further underscore your lack of respect for the people you've been elected to serve. The citizens in your district deserve a representative who respects the PA Constitution and fully understands its meaning. We
hope we have been able to shed some light on why citizens across the
Commonwealth are outraged by the actions and statements of you and your
colleagues. For
you personally, there is only one action you can take to demonstrate a
newfound respect for your office and your constituents:

públicamente le indicó nunca ha leído completamente la Constitución de la
República de Pennsylvania. En el 20 de septiembre de 2005 la cita

del Artículo II, la Sección 8: "no miembro de ni Casa irá durante el
término para que él puede haber sido elegido, recibe cualquier aumento de
salario, o del kilometraje, bajo cualquier ley pasada durante tal
término." En
el 7 de julio de 2005 usted votó afirmativamente en HB 1521, ahora
conocido Actúa como 44, que contiene una provisión por lo cual usted y sus

ha estado en la oficina por casi cinco años y ahora admite la ignorancia
de una provisión constitucional muy básica. Haciendo así, usted lo ha
hecho vacía inconfundiblemente que usted juró un juramento poco sincera y
fraudulento de la oficina en tres ocasiones separadas. Cuando
este juramento es el único juramento Representativo es requerido a hacer
antes de asumir la oficina, nosotros no podemos imaginarnos que una manera
más irrespetuosa tratar a las personas del distrito 180 que forzandolos
ser representados por alguien que no entiende la ley suprema de nuestra
tierra. ¿Cuándo
- si jamás - usted planeó leer la Constitución de la República de
Pennsylvania para determinar si sus acciones sostenían, obedecían, y
defendían sus mandatos? Usted ha caracterizado su posición como "un
trabajo de 24 horas." ¿Le tenido estuvo demasiado ocupado sobre los
pasados cuatro años para revisar un documento usted debe haber leído y
entendió antes de correr para la oficina? A revisar sus acciones y las
declaraciones recientes, la Junta directiva de catorce-miembro de
PACleanSweep ha votado de demandar unánimemente su resignación inmediata
